Introduction and Terms used

The following User Agreement lists the Terms and Conditions of use for TinyTours. Before registering with TinyTours you must agree to accept all the terms of this User Agreement. Any person who does not agree to this User Agreement, or who ceases to agree to the terms of this User Agreement must not use TinyTours. 

The User Agreement is a legally binding agreement between you and TinyTours. The User Agreement is valid from 1 March 2017 and is effective upon acceptance for new users. 

You acknowledge and agree that you have read and do agree to comply with our Privacy Policy www.tinytours.com/help/privacy hereby incorporated by reference into, and made part of this User Agreement.

Definitions

"Booking Request"
means a request by a Customer to make a confirmed booking;
"Confirmed Booking"
means the booking for each Event which is shown on TinyTours as confirmed by the Vendor;
"Customer"
means the person(s) wishing to make a booking with a Vendor for any Event;
"Event"
means the event or activity described in the Offer;
"Offer"
means the Vendor’s listing for any event or activity stipulating the details of the event and its pricing;
"Price"
means the price for the Event as stated in the Offer;
"Referral Partner"
means a person admitted as a member of the TinyTours Referral Partner programme.
"TinyTours” or “We"
means TinyTours Limited trading as TinyTours
“User” or “You”
means the user of TinyTours including Customers, Vendors and Referral Partners; and
"User Agreement"
means the terms and conditions of supply set out herein.

General Conditions for All Users of TinyTours

The use of TinyTours is for parties that fully accept the terms and conditions of use listed in this User Agreement.

The use of the TinyTours is for persons only over the age of 18 years old. You may not use TinyTours if you are under 18 years of age or if your account has been cancelled or suspended.

For persons to register with TinyTours, all of the details you provide must be correct. Personal details will include real name, address, email address, phone numbers, and a valid credit/debit card corresponding to the address or alternative payment method which may include PayPal. You must warrant this information to be true and agree to update your information immediately following any change in the details that TinyTours is holding on your account.

For persons registering a business entity, you must represent that you have authority to legally bind the business entity and warrant that the information provided by you in relation to the business entity is correct - including registered office address, phone numbers, business information, tax/vat numbers and agree to update this information should there be any change in the details that TinyTours is holding on your account. You must also comply with all applicable laws relating to online trading.

TinyTours reserves the right to delay or reject any registration with TinyTours. If your application is rejected TinyTours has no obligation to give a reason for rejection but will generally inform you by email.

TinyTours may reject applications to become Vendors or Affiliates for any reason, including, but not limited to our determination, in our sole discretion, that you or your site are unsuitable to be a Vendor or Referral Partners. Unsuitable pages and sites include, but are not limited to, those that: (a) contain or link to nudity or pornography or promote sexually explicit materials; (b) promote violence; (c) promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age; (d) promote illegal activities; (e) infringe our intellectual property rights or those of any third party or otherwise violate the rights of any third party; (f) contain, in our sole judgment, material that is defamatory, fraudulent, or harassing to us or any third party; (g) have other unsuitable material or intentions or; (h) where the Vendor or Referral Partner has the intention to send unsolicited emails;

If TinyTours subsequently finds that it has been provided with information that is incorrect or misleading, TinyTours reserves the right immediately to cancel the account without prior notice.

TinyTours reserves the right to cancel your account at its sole discretion if it deems that this action is warranted.

TinyTours offers the TinyTours service on an "AS IS" basis, and TinyTours is provided without any warranties whatsoever save in respect of liability for death or personal injury arising out of the negligence or fraudulent misrepresentation of our agents or employees. We hereby disclaim to the fullest extent permitted by law all warranties, conditions, terms, undertakings and representation of any kind, express or implied, statutory or otherwise in connection with TinyTours. This includes without limitation direct, indirect, incidental damages, consequential damages, loss of revenue, loss of data, or loss of business associated with use of TinyTours.

TinyTours provides a platform for Customers, Vendors and Referral Partners but is not involved in or responsible for the transaction between the parties. Should any dispute arise between any of the Customers, Vendors or Referral Partners TinyTours is released without limitation from any dispute between the parties.

TinyTours does not automatically verify or validate the identity of users and is not responsible for ensuring the accuracy or truthfulness of users’ identity or the validity of the information they provide to or post on TinyTours.

TinyTours cannot guarantee the ability of Vendors to fulfil their Offer for Events the ability of Customers to undertake the Events or that the transaction will be completed by the parties.

TinyTours has no control over, does not guarantee and is not responsible for the quality, safety or legality of the Events advertised on TinyTours; the truth or accuracy of the Event details in the Offer or the truth or accuracy of other content posted by users of the TinyTours.

Please do not assume that the Offer, sale or purchase of any Event is valid and legal simply because it is listed on TinyTours. You accept sole responsibility for the legality of your actions under laws applying to you and the legality of any Offers/Events you list, purchase or sell on TinyTours. 

The user of TinyTours is responsible for the security of their account information and log in and password details. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform TinyTours immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner. You agree to accept responsibility for all activities that occur under your account or password and agree not to sell, transfer or assign your subscription or any rights granted to you by TinyTours.

Personal Data Protection and Privacy - TinyTours do not pass on your personal information to any third parties for marketing purposes without your express consent. Some information that is collected from Users may be validated using third parties for the facilitation of the services offered on TinyTours.

Customers need not reveal any public information. However when Users are making a transaction using TinyTours, certain personal details must be passed securely to the other party, including your name, user ID, email address, shipping and billing address and certain financial information. TinyTours cannot guarantee that the other party to your transaction will respect the privacy or security of your information.

If you object to your information being used in this way, please do not use TinyTours.

Tiny Tours shall:

  • not do anything which constitutes an offence under the Computer Misuse Act 1990 or equivalent relevant provisions in any relevant country in which TinyTours operates; and
  • duly observe all of its obligations under the DPA and shall ensure that TinyTours is registered under the DPA as a computer bureau.

Users shall:

  • not do anything which constitutes an offence under the Computer Misuse Act 1990 or equivalent relevant provisions in any relevant country in which TinyTours operates; and
  • duly observe all of their obligations under the DPA and shall ensure that they are registered under the DPA (if applicable)

Information relating to Users may be disclosed to relevant parties i) in the event of a legal dispute ii) where TinyTours is requested by authorities to disclose information or (iii) where TinyTours is obliged to disclose information pursuant to the DPA or similar legislation in any applicable jurisdiction.

Event information and market information including but not limited to event descriptions and information, prices that are listed for public view and sales volumes - may be recorded, analysed and resold by TinyTours. This does not affect your personal information listed in clause1.15.

The number of sales or purchases made by any User may be approximately ascertained by other Users from the number of reviews posted on TinyTours and is therefore publicly available information.

The Price of the Events shall be as stated in the Offer and, unless otherwise so stated, shall be inclusive of any applicable value added tax (which shall be payable by the Customer subject to receipt of a VAT invoice) and any other duties, imposts or levies other than value added tax.

No increase in the Price may be made between the date on which the Booking Request becomes a Confirmed Booking and the date of the Event without the prior consent of the Customer in Writing. Where a Customer has accepted an offer from a Vendor in a different currency the amount payable is in the Vendors currency. It is possible that the actual amount payable by the Customer may vary due to fluctuating exchange rates

The Confirmed Booking is personal to the Customer and the Customer shall not assign or transfer or purport to assign or transfer to any other person any of its rights or sub-contract any of its obligations under the Confirmed Booking.

Any notice required or permitted to be given by either party to the other under this User Agreement shall be in writing addressed to that other party at its registered office or principal place of business or such other address as may at the relevant time have been notified pursuant to this provision to the party giving the notice.

No waiver by the Customer of any breach of this User Agreement by the Vendor shall be considered as a waiver of any subsequent breach of the same or any other provision.

If any of the provisions of this Agreement are judged to be illegal or unenforceable, the continuation in full force and effect of the remainder will not be prejudiced. All clauses relating to licence and ownership, proprietary rights, confidentiality, warranties, non-exclusivity, non-solicitation and waiver shall survive the termination or expiry of this Agreement.

TinyTours grants you a limited non-exclusive revocable licence without right to sublicence to access and make personal use of the TinyTours website and platform, but not to download (other than page caching) or modify it, or any portion of it, except with express written consent of TinyTours. This licence does not include any resale or commercial use of this website or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this website or its contents; any downloading or copying of account information for the benefit of another Vendor; or any use of data mining, robots, or similar data gathering and extraction tools.

This website or any portion of this website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent.

You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of TinyTours without express written consent. You may not use any meta tags or any other "hidden text" utilising TinyTours’s name or trademarks without the express written consent of TinyTours. Any unauthorised use terminates the permission or license granted by TinyTours.

You are granted a limited, revocable, and non-exclusive right to create a hyperlink to any page of TinyTours as long as the link does not portray TinyTours, its referral partners, Vendors or their products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any TinyTours logo or other proprietary graphic or trademark as part of the link without our express written consent

TINYTOURS and other marks indicated on our website are trademarks or registered trademarks of TinyTours, in the United Kingdom and/or other jurisdictions. TinyTours’ graphics, logos, page headers, button icons, scripts and service names are the trademarks or trade dress of Tiny Tours Limited. TinyTours Limited’s trademarks and trade dress may not be used in connection with any product or service that is not TinyTours, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits TinyTours Limited or TinyTours. All other trademarks not owned by TinyTours that appear on this website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by TinyTours.

TinyTours will send all communications to users to their registered e-mail address in their TinyTours account. It is the User’s responsibility to ensure this is correct and up to date at all times.

Subject to the terms and conditions of this User Agreement and TinyTours' policies and procedures, TinyTours shall use commercially reasonable efforts to provide the TinyTours services in a manner that will not disrupt Your business. You acknowledge and agree that from time-to-time TinyTours may be inaccessible or inoperable for reasons including, without limitation: (i) equipment malfunctions; (ii) periodic maintenance procedures or repairs that TinyTours may undertake from time to time; or (iii) causes beyond the reasonable control of TinyTours or that are reasonably unforeseeable by TinyTours, including, without limitation, interruption or failure of telecommunication or digital transmission links, hostile network attacks, network congestion or other failures. You acknowledge and agree that TinyTours is not liable for these periodic interruptions in availability of TinyTours and further acknowledge that TinyTours does not guarantee access to the TinyTours on a continuous and uninterrupted basis.

TinyTours may decline, delist or halt sales or promotion of any Events from TinyTours, suspend funds, adjust commissions based on performance, close an account, and/or suspend or terminate TinyTours at any time, in its sole discretion, without cause or notice to You or any penalty or liability for doing so

TinyTours, in its sole discretion, may suspend or terminate Your account(s), or retain any or all funds in Your TinyTours account, if TinyTours suspects or has reason to believe and/or if a person otherwise claims that You have violated the law or breached any term of this Agreement. In addition to the foregoing, and all other rights and remedies available to TinyTours at law or in equity and notwithstanding anything in the Agreement to the contrary, in the event You breach any term of this User Agreement, or Your account becomes dormant or inactive and/or has a negative balance, TinyTours will have the right to immediately suspend or terminate Your Account and Your rights to access, use and/or otherwise participate in TinyTours. Upon such termination, You agree to immediately cease all use of TinyTours and TinyTours intellectual property licensed in clause 1.27 of this User Agreement. Without limiting the foregoing, TinyTours shall have the right to immediately terminate Your access and use of TinyTours, or any portion thereof, in the event of any conduct which TinyTours, in its sole discretion, considers to be unacceptable.

Following suspension or termination of an account or retaining of funds pursuant to clause 1.32 above, TinyTours will review Your account in a manner determined by TinyTours in its sole discretion. You agree to cooperate with this review if asked. If the review concludes that there is a reasonable basis to believe misconduct has occurred, You agree that TinyTours may retain funds in Your TinyTours account as liquidated damages and/or for the benefit of TinyTours or third parties affected by the misconduct. You acknowledge and agree that such liquidated damages: (a) are not a penalty, and (b) are reasonable and not disproportionate to such presumed damages to TinyTours.

TinyTours may temporarily withhold any portion of the funds in Your TinyTours account if TinyTours, in its sole discretion, determines such action is necessary to secure payment for, performance of, and/or assurances regarding any liabilities, obligations, or indebtedness You may have incurred with TinyTours or any other Person.

No party shall be liable to the other or be deemed to be in breach of the User Agreement by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the Event, if the delay or failure beyond to that party’s reasonable control. Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond either party’s reasonable control:

  • Act of God, explosion, flood, tempest, fire or accident;
  • war or threat of war, sabotage, insurrection, civil disturbance or requisition;
  • acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority;
  • import or export regulations or embargoes;
  • bail-in measures taken by a regulatory or governmental authority to restructure a bank’s debts, the result of which is the confiscation of a depositor’s funds which would otherwise have been applied in satisfying the obligations of the depositor under the terms of this User Agreement;
  • strikes, lock-outs or other industrial actions or trade disputes (whether involving employees or either the Vendor or the Customer or of a third party);
  • difficulties in obtaining raw materials, labour, fuel, parts or machinery;
  • power failure or breakdown in machinery.

You may not assign this User Agreement or any of Your rights and duties hereunder without the prior written consent of TinyTours. This User Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns.

Conditions for Customers

TinyTours provides a platform for Vendors to offer Events for booking and purchase by Customers. TinyTours assists in the facilitation of this process but has no involvement in the processing or fulfilling of any bookings made by Customers. We do not set ticket prices, refund policies, seating availability or guarantee admission to Events. We do not control ticket inventory or availability. We may not be the only distribution channel, and pricing and availability in other channels may vary from us.

The quality and description of the Events shall, subject as provided in this User Agreement, be as stated in the Offer. We have no control over, and do not guarantee the accuracy of the Offer.

You agree not to obtain or attempt to obtain any Items through unauthorised use of any robot, spider or other automated device or any other illegal or unauthorised activity. We reserve the right to cancel any transaction which we reasonably suspect to have been made in breach of these provisions without any notice to you and any and all Items purchased as part of such transaction will be void

We reserve the right to cancel bookings which we reasonably suspect to have been made fraudulently.

Making a Booking Request

When a Customer makes a Booking Request in respect of an Offer it is not a binding contract. The Vendor must confirm the reservation and once the Vendor makes the confirmation the reservation becomes a Confirmed Booking and you will be notified accordingly. In all Booking Requests, the person making the Booking Request shall be deemed to have accepted the terms of this User Agreement on behalf of all persons named in the Booking Request.

All Confirmed Bookings will be subject to any particular terms and conditions of the Vendor which will be detailed with the Offer and re-stated in the Confirmed Booking notification. All purchases are subject to payment card verification and other security checks and your booking may be cancelled if it has not passed our verification process.

The status of your Booking Requests will be sent to you by email or can be monitored in the dashboard section of the website. When you make a Booking Request the status of this Offer is marked as New. When a Booking Request has been accepted by the Vendor the status will be moved to Confirmed. If you do not receive confirmation in the form of a confirmation page or email after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with our customer service team whether or not your booking request has been placed.

You will not be charged until the Booking Request status has been moved to Confirmed.

It is your responsibility to verify that your email address and telephone number are correct before completing an order. We may store and pre-fill the checkout form with your contact information from previous transactions in order to allow a faster checkout experience. Before making a Booking Request it is your responsibility to ensure that this information is correct, and that you can access the email account to which electronic tickets will be delivered. If you cannot access the account to which your tickets have been delivered, it is your responsibility to contact our customer service team as soon as possible to discuss the issue. We shall not be liable for any losses (monetary or otherwise) resulting from your failure to access the email accounts to which your tickets have been delivered, or if the contact details for the transaction are incorrect.

You may not resell or transfer your Confirmed Booking if prohibited by law. In addition, Vendors may prohibit the resale or transfer of Confirmed Bookings for some Events. Any resale or transfer (or attempted resale or transfer) of a Confirmed Booking in breach of the applicable law or any restrictions imposed by the Vendor is grounds for seizure or cancellation of that Confirmed Booking without refund or other compensation.

Customers must pay the Vendor in the Vendor’s nominated currency. When paying in a different currency this may lead to a slight deviation in the amount that is billed. The Customer must accept this possible variation in Price due to fluctuating exchange rates. This may also effect a reimbursement where money is repaid in the Vendors currency at a subsequent date. Customers must also accept this possible variation in the reimbursement value.

Compliance with Event requirements

Vendors may attach conditions and/or eligibility requirements for participation in their Events. It is your responsibility to ensure compliance. Failure to comply with all conditions/requirements may result in your being excluded from participation at the sole discretion of the Vendor.

Insurance is not included in the price of an Event unless specifically stated in the Offer. You are responsible for ensuring you have appropriate insurance for the Event.

Cancelled and Postponed Events

Occasionally, Events are cancelled or postponed by the Vendor.

It is your responsibility to ascertain whether an Event has been cancelled and the date and time of any rearranged event. If an Event is cancelled or rescheduled, we will use reasonable endeavours to notify you of the cancellation once we have received the relevant authorisation from the Vendor. We do not guarantee that you will be informed of such cancellation before the date of the Event. Please note that advertised start times of events are subject to change. All Confirmed Bookings are subject to the Vendor’s right to alter or vary the programme due to events or circumstances beyond its reasonable control without being obliged to refund monies or exchange tickets.

If an Event is cancelled, please contact www.tinytours.com/help/ for information. Please make sure to include your full name, the email address to which the ticket was delivered, and the telephone number used in the transaction.

Personal arrangements including travel, accommodation or hospitality relating to the Event which have been arranged by you are at your own risk. Neither we nor the Vendor(s) shall be liable to you for any loss of enjoyment or wasted expenditure.

Unless otherwise stated in this User Agreement, our and the Vendor(s)' liability to you in connection with the Event (including, but not limited to, for any cancellation, rescheduling or material change to the programme of the Event) shall be limited to the price paid by you for the Event including any per Event service charge but excluding any per order handling fee.

Cancelling a Booking, Refunds and Exchanges

If You wish to cancel a Confirmed Booking for any reason, You must first contact the Vendor. All cancellations, refunds and exchanges will be considered in accordance with the Vendor’s terms and conditions. All cancellation requests must be made no less than 24 hours before the start time of the Event.

We act as the agent of the Vendor, and as such, only offer cancellations, refunds and/or exchanges on behalf of the Vendor based on the Vendor’s instructions. Tickets are non-cancellable and non-refundable, unless otherwise stated by the Vendor. We are not obligated to issue a refund except to the extent that the Vendor instructs us to do so. In order to receive a refund or an exchange that may be offered, you will have to comply with the Vendor’s instructions or deadlines, which, along with the decision about whether or not to issue a refund or an exchange, may be at the absolute discretion of the Vendor. For the avoidance of doubt, in no event will TinyTours provide a refund where the Vendor does not actually approve and agree a refund with you.

In the event that we issue you with a refund for a ticket, it will be issued on the face value paid for the ticket (or, if a discounted ticket, then instead the discounted ticket price paid). We do not guarantee that service fees will be refunded.

Delivery charges and any other ancillary fees will not be refunded.

If a refund is issued, it will be issued using the same method of payment that was used to purchase the Items. If a credit card was used to make the refunded purchase, then only that actual credit card will receive the credit for the refund.

You agree not to contact us to seek a refund or exchange without first seeking authorisation to do so from the Vendor directly, and you will not dispute or otherwise seek a “chargeback” from the company whose credit card/debit card you used to purchase tickets through our Purchase Channels. Should you do so, your tickets may be cancelled, and we may suspend you and refuse to honour future ticket purchases made from all credit/debit card accounts or online accounts on which such chargebacks have been made, and may prohibit all persons in whose name the credit card accounts exist and any person who accesses any associated online account or credit card or who otherwise breaches this provision from using TinyTours.

When providing information regarding a Refund to the Vendor you must warrant that the information that you provide is true and valid.

Pricing and Other Errors

If the amount you pay for a ticket is incorrect for any reason, regardless of whether this is because of an error in a price posted on the website or otherwise communicated to you, or you are able to order a ticket that was not intended for sale at the time of purchase, then we may cancel that transaction and refund to you the amount that you paid. This will apply regardless of whether because of human error, unauthorised pricing/ticket changes or a transactional malfunction of our website.

Liability

Neither we nor the Vendor(s) will be liable for any loss, injury or damage to any person (including you) or property howsoever caused (including by us and/or by the Vendor(s)): (a) in any circumstances where there is no breach of a legal duty of care owed by us or the Vendor(s); (b) in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach (save for death or personal injury resulting from our negligence); or (c) to the extent that any increase in any loss or damage results from breach by you of any of the terms of this User Agreement and/or any terms and conditions of the Vendor(s) or your negligence.

Conditions for Vendors

TinyTours will admit Vendors to TinyTours at its sole discretion. Applying to become a Vendor on TinyTours does not guarantee that any applicant will be accepted and permitted to other Events using TinyTours. TinyTours will alert the Vendor when they have been accepted as a Vendor.

The Vendor is responsible for their price listings. The Vendor shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding the use of TinyTours and the listing, solicitation of offers to purchase, the purchase and the provision of the Events on TinyTours.

Where the Vendor has provided information, the Vendor must warrant that the listing is accurate and not in any way misleading to a potential Customer.

Vendors can classify an Event as either ‘Anytime’ or ‘Scheduled’. Where an Event is classed as ‘Anytime’, a Booking Request will be processed automatically by TinyTours and it will immediately be deemed a Confirmed Booking. Booking Requests for a ‘Scheduled’ Event will only become Confirmed Bookings once the Vendor updates the Booking Request. Vendors agree to respond to all Booking Requests within 24 hours of notification of the Booking Request by TinyTours. Any Booking Requests not responded to within 24 hours will be deemed to be rejected by the Vendor

Once a Vendor accepts a Booking Request and it becomes a Confirmed Booking the Vendor is obliged to provide the Event on the terms of the Offer.

Where an Event is to be modified or cancelled by the Vendor, reasonable notice of all such changes shall be notified to both TinyTours and the Customer as soon as possible.

Where TinyTours provides the Vendor with Customer personal information the Vendor undertakes and agrees to use all such information solely for provision of the Event. The Vendor hereby covenants and undertakes not to include Customers who have made Confirmed Bookings via TinyTours but who have not previously been customers of the Vendors in any combined customer lists or to contact the Customer for any reason unconnected with the Event.

The Vendor shall indemnify TinyTours in full against all liability, loss, damages, costs and expenses (including legal expenses) awarded against or incurred or paid by TinyTours as a result of in connection with:

  • Breach of any warranty given by the Vendor in relation to the Event;
  • any act or omission of the Vendor or its employees, agents or sub-contractors in supplying or delivering the Event.

Conditions for Referral Partners

Referral Partners may make Booking Requests on behalf of Customers where such Customer is also a customer of the Referral Partner and all such Booking Requests will be purchased by the Referral Partner as agent for the Customer and accordingly any contract of purchase will be entered into between the Customer and the relevant Vendor.

The Referral Partner warrants that they have the authority to make the Booking Request and to provide the Customers personal information in order to make the Booking Request on behalf of the Customer and will indemnify TinyTours against all liability, loss, damages, costs and expenses (including legal expenses) awarded against or incurred or paid by TinyTours as a result of or in connection with breach of this warranty.

Where a Customer has requested that a Referral Partner make the Booking Request on their behalf, the Customer agrees to indemnity TinyTours in full against all liability arising from the Booking Request being made by the Referral Partner on their behalf.

Affiliates must agree that they will not engage in any activity that brings the TinyTours brand into disrepute.

Referral Partners must respect Vendors’ trademarks and not bring TinyTours or any Vendor into disrepute.

The Referral Partners must use only TinyTours official promotional materials as provided to them from time to time and will not make any authorised use of TinyTours trademarks, logos, domain names or any related intellectual property without the prior approved of TinyTours.

Where a Referral Partner is using any form of link – the link must direct to TinyTours and not another website.

TinyTours may terminate the Referral Partners account with immediate effect where the Referral Partner has broken the terms of this Agreement.

Where the Referral Partner has been in breach of the terms or TinyTours deems at its sole discretion that the Referral Partner has brought TinyTours into disrepute, no outstanding monies will be credited to the Referral Partners account.

TinyTours Fees Overview

Customer Fees

There is no charge to Customers using TinyTours.

Vendor Fees

Vendors must agree to the fee structure of TinyTours before listing any Offers. The Vendors fees will be based on the Vendor’s individual agreed transaction rates.

TinyTours processes payments of all Booking Requests once they have become a Confirmed Booking

TinyTours will reimburse the Vendor every 30 days with the money it has received for the Vendor based on the completed Events for the Vendor listed during that period (Fees Transfer). TinyTours will deduct the fees owed by the Vendor to TinyTours from the Fees Transfer at this point. The amount owed and taken from the Vendors account will be listed in their Accounts page.

Transfers should arrive to the Vendor within 5 Business Days of the last day of each calendar month by the Vendors selected method.

Where a Vendor cannot fulfil a Booking Request that has become a Confirmed Booking the Vendor will have to issue a cancellation notice to the Customer and subsequently refund the Customer.

TinyTours will monitor the number of sales and chargebacks for a Vendor. TinyTours, at its sole discretion, may impose transaction limits on a Vendor. TinyTours may also delay the transfer of funds to the Vendor where there are, in the opinion of TinyTours, a critical number of Customer disputes or chargebacks.

Where chargebacks occur to TinyTours, TinyTours may seek to recover these from the Vendor. TinyTours will seek the simplest way to recover this money, and can obtain reimbursement by deducting the amount from payments due to the Vendor. Should this not be applicable, TinyTours may obtain reimbursement by reversing any Transfer to the Vendors bank account, charging the Vendors’ credit card, or by any other lawful means.

Referral Partner Commission

Commission is payable in respect of all Confirmed Bookings made by a Referral Partner on behalf of a Customer.

Commission is payable on the value of the Confirmed Booking

Subject to a minimum commission value of £50 having accrued, commission is payable monthly in arrears. Eg: April commission is paid on or before the last day of May .

Conditions for Information and the Provision of Information to TinyTours 

TinyTours has a number of areas where feedback can be provided on other Users or Events. Any information provided by a User is fully their responsibility. When submitting feedback information Users must be aware that they are fully responsible for the feedback they have provided. Where a dispute or action arises from feedback between parties, TinyTours is held harmless for any feedback on the website.

Feedback and submission of information must not be offensive, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, or objectionable and must not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam”. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of any content. TinyTours reserves the right (but not the obligation) to remove or edit any content.

Purposely invalid information or abuse of the system to boost an Event or Vendors rating, denigrate a Customer’s rating or Vendors rating, or purposely provide incorrect Event information - may result in the cancellation of the Users TinyTours account without notice.

When content or data of any kind outside personal private information is given to TinyTours, you agree to give TinyTours a worldwide, continual, non-exclusive, royalty free, sublicenceable rights to this data and to all trademark and intellectual property rights you have in this content. By this content we mean without limitation product data, images and related content. You agree that the rights you grant above are irrevocable during the entire period of protection of your intellectual property rights associated with such content and material. You agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content. You agree to perform all further acts necessary to perfect any of the above rights granted by you to TinyTours, including the execution of deeds and documents, at the request of TinyTours

You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is submitted to TinyTours: (i) the content and material is accurate; (ii) use of the content and material you supply does not breach any applicable TinyTours policies or guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory). You agree to indemnify TinyTours for all claims brought by a third party against TinyTours arising out of or in connection with a breach of any of these warranties.

It is not possible for TinyTours to be aware of the contents of each product listed for sale, or each comment or review that is displayed. If you believe that any content on, or advertised for sale on, the website contains a defamatory statement, please notify TinyTours immediately and we will make all reasonable endeavours to remove the defamatory content complained about within a reasonable time.

Conditions for Information and the Provision of Information to TinyTours 

TinyTours reserves the right to amend this User Agreement at its sole discretion. Amendments can be made by the posting of changes to this page. It is the responsibility of the User to understand any such changes. The continued use of TinyTours will require that the User accepts any amendments to this User Agreement. TinyTours has no requirement to notify Users of these amendments beyond posting them to this User Agreement.

Conditions for Information and the Provision of Information to TinyTours 

This User Agreement shall be governed by and construed in accordance with the laws of Northern Ireland. You and TinyTours both agree to submit to the non-exclusive jurisdiction of the Courts of Northern Ireland.
