IRISH HEARTBEAT TOURS 
These Terms and Conditions contain legal obligations and Irish Heartbeat Tours encourages you to read them carefully before making a booking. It is under these Terms and Conditions that bookings are made and accepted by Irish Heartbeat Tours. Unless otherwise stated, any bookings and purchases made through www.tinytours.com are subject to these Terms & Conditions. When a Customer makes a booking it will be deemed they have accepted the Terms & Conditions on behalf of all  individuals included in the booking and consents to these Terms & Conditions by using  www.tinytours.com. No alterations or variations to these Terms & Conditions will be accepted unless agreed in writing by Irish Heartbeat Tours.

Below is a comprehensive description of the Terms and Conditions by which Irish Heartbeat Tours and clients can be expected to abide. Please note that, while some might appear excessive for the scale of the 'Brown Eyed Girl' walking tour, they are included to protect both Irish Heartbeat Tours and clients alike. 

BOOKING
All cancellations or changes to online bookings will be managed by the booking agent Tiny Tours, see website www.tinytours.com for details. Once a tour begins no refunds will be given. Irish Heartbeat Tours reserve the right to change the route, start/finish locations and scheduled stops, the reasons for changes may include, but not exclusively, ‘Special Events’ ‘Parades’ ‘Festivals’, ‘Outdoor Concerts’, or  'Road Closures'. We will give notice of changes via the Website (Latest News) or during the safety brief before the tour begins. Tours will take place come ‘rain or shine’ participants are advised to check the local weather forecasts, and have suitable clothing for inclement weather even in the summer months. In addition, the terrain underfoot is generally sound but participants should wear suitable footwear for a walking tour. All tours operate subject to availability. Irish Heartbeat Tours reserve the right to cancel a tour in advance or on the day of a tour if 1) they consider the prevailing weather conditions unsuitable, 2) they consider it unsafe to operate, 3) they are unable to operate due to circumstances beyond their control and 4) When on occasion, domestic commitment, travel disruption, illness, holidays or circumstances beyond their control prevent them from operating. In these circumstances tours can be re-scheduled or a full refund offered.

PAYMENT TERMS
1. Payments will be applied at the time of booking. 

2. Full payment is due before commencement of tour.

REFUNDS
1. Refunds for online bookings will be processed by the authorised booking agent ‘Tiny Tours’. 

2. No refunds for cash transactions will be given once the tour begins.

YOU ACCEPT RESPONSIBILITY FOR YOUR OWN SAFETY - INSURANCE
We strongly recommend that each person on the 'Brown Eyed Girl' tour have appropriate comprehensive health, accident, activity and trip insurance

PRIVACY POLICY
Your information will not be disclosed to any third party and will only be used for the purpose of this website. We reserve the right to contact you after your tour to receive feedback in an effort to improve every level of our service. If you do not wish to be contacted please email irishheartbeattours@yahoo.com and we will remove you from our mailing list. Photographs / video taken on our tours may at times be used for promotional purposes through our social media networks and the Tiny Tours website.

MINIMUM NUMBERS
Bookings may be made for single participants. .

MEDICAL CONDITIONS
Participants should make Irish Heartbeat Tours aware of any existing medical or short term medical conditions before the tour begins. The tour leader will decide if the participant can proceed with the tour, based on the information presented to them. No refund will be given for participants who are deemed by the Tour Leader to be unfit to proceed with the tour.

NO SHOW
If the client(s) for the booked tour does not arrive on time Irish Heartbeat Tours will have the right to receive the full cost of the tour. You are responsible for ensuring that you follow instructions provided by Irish Heartbeat Tours in respect of arrival times for the walking tour. Irish Heartbeat Tours cannot be liable for any loss or expense suffered by participants because of their late arrival or failure to follow the instructions provided.   

ALCOHOL & DRUGS
If a participant is deemed to be under the influence of alcohol/drugs and therefore a risk to themselves and others, they will not be permitted to take part in the tour, no refund will be given.

UNDER 18’s
Participants 18 or under must be supervised at all times by a responsible adult (over 18). The responsible adult must also ensure that under 18’s in their care have fully understood the Health & Safety briefing.

LOSS AND DAMAGE
Irish Heartbeat Tours will not be held responsible for any loss or damage to personal items, valuables or clothing during the tour, participants will be expected to manage the security of all personal belongings for the duration of the tour.

DESCRIPTION INFORMATION PAGE / MANAGING EXPECTATION
All information displayed on the Tiny Tours web-site is provided in good faith and we cannot be held responsible for any inaccuracies. If you do find errors we would be grateful if you would please let us know. Irish Heartbeat Tours will endeavour to exceed the expectation of participants during the tour and provide an enjoyable and memorable experience, but it or its agents cannot be held responsible for circumstances outside its control, and for any deviation in the planned route or access to buildings or other ‘areas of interest’

SAFETY BRIEF / FOLLOWING INSTRUCTIONS
At the start of the tour the guide will give a general safety brief and all participants will be expected to follow all reasonable instructions given to them by the tour leader. Any participants thought by the tour leader to be disregarding reasonable instructions given to them and thus endangering themselves or others will be asked to leave the tour. In this instance no refund will be given. 

NOT INCLUDED IN THE COST OF THE TOUR
Refreshments, apart from Irish Heartbeat Tours supplying one bottle of bottled still water and a small sweet confectionery (may contain nuts and gluten) to each participant, are not included in the cost of the walking tour.

LIABILITY / PERSONAL INJURY DISCLAIMER
Irish Heartbeat Tours will not be held responsible for any injury, accident or incident during the 'Brown Eyed Girl' walking tour. As walking is a physical activity and because tours take place near public thoroughfares, it could potentially result in injury or loss, including death. By accepting the Terms and Conditions on the Booking Form on the Tiny Tours Bookings Page, all participants are agreeing to the following personal statement:

I understand the nature of the Irish Heartbeat Tours 'Brown Eyed Girl' tour activity, that it may involve physical activity and that I am qualified being in good health and in proper physical condition to participate in this activity. I do so voluntarily. I will accept my guide’s instructions during the sight-seeing walking 'Brown Eyed Girl' tour. I understand that all streets adjoining the routes will carry public and private transportation and therefore vehicular traffic. I will obey all traffic laws and regulations. I am aware that no water stations exist on the routes and limited access to public toilets. I understand therefore the risks and dangers of serious bodily injury, including permanent disability, paralysis and death. I understand that these risks and dangers may be caused by my own actions or inactions, the actions or inactions of others and/or the condition in which the activity takes place. I understand that there may be risks both social and economic losses either not known to me or not readily foreseeable at this time and I fully accept and assume all such risks and responsibility for losses, costs and damages that I may incur as a result of the participation in the activity. I will notify Irish Heartbeat Tours 'Brown Eyed Girl' walking tour of any medical condition or medication that I am taking which may affect my participation.

COMPLAINTS
Irish Heartbeat Tours take pride in the organisation and conduct of the walking tour. However, should you be dissatisfied with any aspect, please let us know as soon as possible. We will attempt then to find an immediate solution that is acceptable to you. If for some reason the problem is not immediately resolved to your satisfaction, then it should be put in writing and sent to Irish Heartbeat Tours via e-mail within fourteen days at the end of the walking tour. Although I doubt that they would reach that stage, any disputes arising from the contract between us will be governed by UK law.

INDEMNITY
Irish Heartbeat Tours may hold you liable for any loss, expenses (including but not limited to reasonable legal costs and disbursements), and damages arising from or incurred by reason of any claims, demands, actions that arise as a result of your breach of these terms and conditions. This indemnity shall not apply to the extent any such claim or demand or action as a result of Irish Heartbeat Tours breach of these terms and conditions.

INTELLECTUAL PROPERTY
The information imparted on the tour is the intellectual property of Irish Heartbeat Tours
